By creating an account, accessing, or using imTalker at https://imtalker.com, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, please discontinue using the service immediately.

2. Description of Service

imTalker provides an AI-driven Mandarin Chinese spoken dialogue tutoring system designed for learners worldwide. Key capabilities include:

• Realistic Phone Practice: Interactive spoken communication with native AI teacher persona "Teacher Xiaoyu", featuring sub-700ms ultra-low latency full-duplex telephony and natural speech interruption;
• Scenario Rehearsal & Memory: Targeted practice for real-life situations (borrowing a power bank, ordering coffee, dinner icebreakers, job interviews) with persistent memory of learner facts across sessions;
• Review Reports & Flashcards: Post-call learning accomplishment highlights, phrasing recommendations, and adaptive flashcard retention for newly practiced vocabulary.

3. User Accounts & Access

You may register and sign in securely via Google OAuth 2.0. You are solely responsible for maintaining the confidentiality of your access credentials and for all activities conducted under your account. Accounts are strictly personal and non-transferable; automated scraping, credential sharing, or unauthorized third-party access is prohibited.

4. Free Trial & Subscriptions

Public Free Trial: All registered learners receive an initial 10-minute free trial of real conversational telephony practice. No credit card or payment authorization is required to use the free trial.

Paid Subscriptions: Formal paid subscription plans and minutes add-on packs are currently in preparation and will be made available in an upcoming release. When commercial billing opens, plans will feature transparent pricing, clear renewal terms, and customer protection guarantees.

5. Acceptable Use Policy

When interacting with the service, you agree not to:

• Transmit defamatory, harassing, sexually explicit, hateful, or unlawful voice or text content;
• Reverse engineer, decompile, extract proprietary voice models, or intercept backend VoIP infrastructure;
• Resell allocated telephony minutes or utilize the service as a commercial telemarketing outbound system;
• Attempt any attacks that disrupt platform availability, server stability, or communication security.

Violation of these rules may result in immediate suspension or termination of account access.

6. Disclaimers & Limitation of Liability

imTalker is an AI-assisted language learning tool provided on an "AS IS" and "AS AVAILABLE" basis. While Teacher Xiaoyu's generative responses are carefully aligned for educational quality, occasional conversational inaccuracies may occur. To the maximum extent permitted by applicable law, imTalker Inc. shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the service.

We reserve the right to modify these Terms as our service evolves. Continued use of imTalker after modifications constitutes acceptance of the updated terms. These terms are governed by and construed in accordance with applicable laws.
